Lori D. Counts-Smith is a member of Lewis Glasser. Her practice focuses primarily on litigation in a variety of areas including, but not limited to: labor and employment law with an emphasis on disputes under the West Virginia Wage Payment and Collection Act and the Fair Labor Standards Act; commercial law; landlord-tenant disputes; West Virginia taxation matters; insurance defense for national companies and personal injury. Mrs. Counts-Smith also concentrates her practice in the area of estate planning, estate administration and estate litigation matters.
Mrs. Counts-Smith earned a B.S. in Business Administration and a B.S. in Accounting from The University of Charleston, West Virginia in 2007. Mrs. Counts-Smith earned her Doctor of Jurisprudence from West Virginia University College of Law in 2010. Since graduation, Mrs. Counts-Smith has been admitted to the West Virginia State Bar and is also licensed to practice in the United States District Court for the Southern District of West Virginia.
Among her recent engagements, Mrs. Counts-Smith has represented entities before the West Virginia Office of Tax Appeals regarding sales and use tax audit discrepancies; an individual against their prior employer for alleged violation of the Fair Labor Standards Act, alleged wrongful termination, and alleged harassment; companies under investigation by the U.S. Department of Labor for alleged violation of the Fair Labor Standards Act; companies under investigation by the West Virginia Department of Labor; a non-profit entity with regard to claims before the Office of Medicare Hearings and Appeals; landlords in local magistrate court proceedings with regard to eviction proceedings and property damage claims; and a national insurance company in state court for Infant Summary Proceedings. Ms. Counts-Smith has assisted employers with drafting offer of employment letters and personal policies and procedures.
Ms. Counts-Smith has also recently handled prenuptial agreement matters and estate planning for several individuals.
Additionally, Mrs. Counts-Smith is a member of the Rotary Club of Charleston, West Virginia; is a representative of the Kanawha County District for The Young Lawyers Section Executive Committee of the State Bar; is a board representative for the Kanawha County Bar Association; and is a member of the West Virginia Women Attorneys group.
