WV DEP to Maintain Full Enforcement During COVID-19 Crisis

The West Virginia Department of Environmental Protection (WVDEP) announced yesterday, in consultation with the United States Environmental Protection Agency (EPA), that all rules, regulations and permitting requirements under the jurisdiction of the WVDEP remain in full effect during the COVID-19 crisis. However, WVDEP has recognized that potential compliance challenges face the regulated community, including the oil and gas industry, due to the extraordinary nature of the COVID-19 restrictions and potential illnesses associated with pandemic (including challenges associated with reduced staffing and social distancing guidelines). 

Regulated parties have been instructed to contact the WVDEP if compliance is not reasonably practicable due to issues related to the COVID-19 pandemic. It is incumbent on companies to be proactive and work with WVDEP should they recognize that compliance obligations cannot be met.
